Last week the Massachusetts Department of Public Health released a draft version of new room regulations for long-term care facilities in response to the challenges brought by the COVID-19 pandemic. The draft version is open to public comments through 11/13/2020. (105 CMR 150.320)

The purpose of these updated regulations is to improve infection control procedures in skilled nursing and other residential care facilities.
1. Under the regulatory revisions, facilities would need to convert all residential bedrooms to single or double-occupancy rooms by Jan. 31, 2022.
2. The proposal increases the required net square footage per residents/patients in double occupancy rooms and imposes larger clearances between beds and between the beds and the wall. This will make many existing double-occupancy rooms unable to accommodate two beds without renovation.
